SITE USAGE RULES AND REGULATIONS
Cooper Capital Specialty Salvage, LLC (‘CCSS, LLC’, ‘We’, ‘Our’) hereby notifies you, the potential buyer, of the terms, conditions and requirements of using and bidding on this website. You will be required to accept these Site Usage Requirements prior to becoming a successful bidder on any asset listed on this website. Failure to accept the posted requirements, which may be amended from time to time, will prevent you from successfully bidding on an asset or from website usage.
SERVICES OFFERED BY CCSS, LLC
CCSS, LLC lists assets for sale to bidders in the marketplace. Typically, the assets are sold via a Sealed Bid Program. CCSS, LLC is not a dealer, auctioneer or broker. Instead, CCSS, LLC will post assigned assets for sale, and buyers may bid on assets pursuant to our bidding procedures. We do not own the assets or take title at any time. CCSS, LLC does not make representations or warranties, expressed or implied, regarding the offered assets. CCSS, LLC attempts to supply accurate information for each asset. However, we cannot offer any guarantee concerning the accuracy of the information provided on this website. Buyers must perform their own due diligence prior to registering a successful bid. All of our assets are sold free and clear of any liens, claims or other encumbrances unless otherwise indicated. CCSS, LLC does not warrant any information based on any survey supplied by the asset owner or the owner’s representative. Most assets bring considerably more than the minimum bid and the minimum bid amount does not obligate Cooper Capital Specialty Salvage, LLC to sell the asset. Cooper Capital Specialty Salvage, LLC reserves the right to reject any and all bids for any reason on any asset listed for sale.
BIDDING - ALL BIDS MUST BE MADE VIA INTERNET REGISTRATION.
FEES
CCSS, LLC may change its fees and penalties at any time by posting revised rules and regulations. All fees are in U.S. currency.
THERE WILL BE A BUYER’S PREMIUM ADDED TO EACH SUCCESSFUL HIGH BID, WHICH BID IS TO BE RECEIVED BY CCSS, LLC BY WIRE TRANSFER WITHIN 48 HOURS. THE BUYER’S PREMIUM CAN VARY PER ASSET. AT THE TIME THE BID IS PLACED, THE BIDDER SHALL SEE THE BUYER’S PREMIUM ASSIGNED TO THAT ASSET.
There is an administration fee of $45.00 applied to each asset for all paperwork and form processing.
If you are the successful bidder and have not paid in full for the asset purchased within said 48-hour window, an additional 4% late fee will apply (4% in addition to purchase price plus buyer''s fee), and your account will be suspended. Payment of the late fees and penalties are required to return your account to good standing.
If you have not completed your transaction within 7 calendar days, a $2,500.00 penalty will be assessed, which fee, in addition to any other charges, must be paid prior to the release of the asset. If late fees and penalties are not paid, title will not transfer.
Furthermore, CCSS may refuse to consider future bids from defaulting buyers on the sale of future assets.
TAXES
The buyer is responsible for determining the requirement of and paying any and all use, sales, transfer, or any other taxes. All taxes are to be paid by the buyer in the state where the purchase occurred. CCSS, LLC assumes no responsibility to determine whether any taxes are due on said purchase and we assume no liability for non-payment. We will not report to the taxing authority whether taxes are due on this transaction. This is your responsibility.
ASSET RELEASE
You must pay by wire transfer for your purchase within 48 hours. You will be provided with wiring instructions.
Each listing will have a Release Date. You are to schedule with the storage facility the date and time of pickup. You will be required, prior to release of the asset, to sign a document wherein you agree to pay all storage charges beyond the release date. You should make appropriate arrangements with the storage facility should you not be able to pick up the asset by the designated date and time. THE SELLING PAPERWORK WILL NOT BE FORWARDED TO THE BUYER UNTIL CCSS, LLC HAS RECEIVED CONFIRMATION THAT THE STORAGE FACILITY AND BUYER HAVE MADE CONTACT REGARDING PICKUP AND/OR ADDITIONAL STORAGE ARRANGEMENTS.The buyer is responsible for all loading and transportation fees.
Buyer will NOT be allowed to make any claims against CCSS, LLC for misrepresentation or for missing items after the scheduled pickup date. No adjustments will be made for ANY discrepancies. Please bid accordingly. Assets are being sold AS IS, WHERE IS.
SELLING PAPERWORK
The Title, Registration, Bill of Sale, and/or Coast Guard Document transfers will be put in the name of the REGISTERED BUYER. No exceptions. You will be provided the selling paperwork for any asset as it was provided to CCSS, LLC. As part of completing this transaction you will be required to sign and return to CCSS, LLC the Bid Award Notification Terms and Conditions and a letter (provided by CCSS, LLC) confirming that you have contacted the storage facility to make appropriate arrangements concerning pickup and/or additional storage.
USER REPRESENTATIONS
When you use our website, you represent that you are 18 years or over and have the authority to enter into valid, legally binding contracts. CCSS, LLC may terminate your right to register and bid on items at our discretion. You will provide CCSS, LLC with accurate information in your registration materials. If more information is required, you must provide said information to us. Any violation of CCSS, LLC’s rules and regulations or any violation of any laws that regulate our website or our business will result in the termination of your use of this website.
ASSET INFORMATION DISCLAIMER
As previously mentioned, CCSS, LLC is generally provided with surveys/appraisals by a third party concerning the assets listed for sale on this website. CCSS, LLC cannot vouch for the accuracy of the information provided or the condition of the asset. CCSS, LLC does not make any representations or warranties of our kind, expressed or implied, as to the information provided, completeness of the information or accuracy of the information provided, or as to the condition of the asset.
CCSS, LLC cannot warrant, in any way, the fitness of the assets offered for a particular use, and cannot offer any expressed or implied warranties as to the information on this website or the asset listed.
AGREEMENT ON LOCATION OF DISPUTES
CCSS, LLC is a Connecticut LLC. All disputes related to the asset sales or arising out of these Rules and Regulations will be governed by the State or Federal courts in Connecticut and you agree that any and all disputes must be brought in said jurisdictions.
These Rules and Regulations, along other forms on our website that you will use, define the entire relationship between you and CCSS, LLC regarding any and all assets for sale on this site, and supersedes any and all previous written or oral agreements.

Refund Policy:
All Sales Final, No Refund Policy. This "All Sales Final, No Refund" policy applies to all boat auctions conducted by Cooper Capital Specialty Salvage,LLC through our website or any other platform where our auctions are hosted. All sales of boats through our auctions are considered final once a winning bid has been placed and the purchase is completed. By participating in our auctions and placing bids, you acknowledge and agree that you are entering into a binding contract to purchase the boat in question.
Except the following circumstances:
if the boat is determined to be stolen, illegally obtained, or subject to legal disputes that prevent transfer of ownership to the winning bidder. If the sale is canceled or invalidated due to reasons beyond the control of the winning bidder or us, such as technical errors, fraudulent activity, or legal requirements.
Inspection & Due Diligence:
We strongly encourage all bidders to conduct thorough inspections and due diligence on any boat they intend to bid on before placing a bid. Bidders are responsible for reviewing all available information, photos, and descriptions provided for each boat, as well as conducting their own inspections or obtaining professional assessments if necessary.
Dispute Resolution:
In the event of any dispute regarding a purchase made through our auctions, we will strive to resolve the issue fairly and promptly. However, our decision regarding the application of this "All Sales Final, No Refund" policy shall be final and binding.
Modifications to Policy:
We reserve the right to modify or update this policy at any time without prior notice. Any changes will be effective immediately upon posting on our website or other auction platforms.
